Dual Agent

In some situations, the Agent's responsibilities may be unclear when they have conflicting motivations whenever they assist both the Buyer and Seller in the transaction. A Dual Agent: - Is one Agent representing the Buyer and the Seller but ONLY if both parties consent.
- Only with the Seller's consent can they inform the Buyer if the Seller is willing to accept a lower price.
- Is prohibited from disclosing any information that may inform the Buyer of the motivation of the Seller, unless the Seller gives permission.
- Cannot put the Buyer at an advantage when negotiating any repairs.
- Without the Seller's consent, cannot disclose any confidential information that would place the Buyer at an advantage over the Seller.
- Is the only Agent paid, so they keep the entire commission.
There are two ways to end up working with a Dual Agent: - You see a home and make an offer with only the listing Agent involved. You will have one Agent dealing with the Buyer and the Seller. If both parties consent then the Agent will be a Dual Agent.
- You begin working with a Buyer's Agent but that Agent shows you a home that they have listed. The relationship began as a Buyer's Agent but could change to a Dual Agent.
